Bunlar\u0131n birincisi metin, ikincisi \u015ferh, \u00fc\u00e7\u00fcnc\u00fcs\u00fc h\u00e2\u015fiye&#8217;dir. Metin \u015eeyh\u00fc&#8217;l \u0130sl\u00e2m Muhammed bin Abdullah Timurt\u00e2\u015f\u00ee&#8217;ye ait olup \u00abTenvir\u00fc&#8217;l &#8211; Ebs\u00e2r\u00bb ad\u0131n\u0131 ta\u015f\u0131maktad\u0131r. \u015eerh, Muhammed Al\u00e2addin bin Ali el-Haskef\u00ee&#8217;nin eseri \u00abed-D\u00fcrr\u00fc&#8217;l-Muhtar\u00bb, h\u00e2\u015fiye de \u0130bn-i \u00c2B\u0130D\u0130N Muhammed Emin&#8217;in yazd\u0131\u011f\u0131 \u00abRedd\u00fc&#8217;l-Muhtar ale&#8217;d D\u00fcrr\u00fc&#8217;l-Muhtar \u015ferhi Tenvir\u00fc&#8217;l-Ebsar\u00bb d\u0131r. Bin\u00e2enaleyh musann\u0131f denilince Muhammed bin Abdullah Timurt\u00e2\u015f\u00ee, \u015f\u00e2rih denilince de Haskef\u00ee anla\u015f\u0131l\u0131r.<\/p>\n<p>Hanef\u00ee mezhebinin, mufassal f\u0131k\u0131h kitaplar\u0131ndan \u00abFeth\u00fc&#8217;l-Kadir ve Bed\u00e2iu&#8217;s-San\u00e2yi\u00bb gibi muteber bir eseri terceme etmeyi birka\u00e7 senedir d\u00fc\u015f\u00fcn\u00fcyor, bu b\u00e2bta baz\u0131 dostlar\u0131mdan te\u015fvikler de g\u00f6r\u00fcyordum. Nihayet karar\u0131m\u0131 verdim ve terceme i\u00e7in \u0130BN-\u0130 \u00c2B\u0130D\u0130N&#8217;i se\u00e7tim. Buna sebep mezkur eserin b\u00fct\u00fcn mufassal kitaplar\u0131n bir hul\u00e2sas\u0131 mesabesinde olu\u015fudur. Zira fukaha taraf\u0131ndan \u00fczerinde s\u00f6z edilmi\u015f hi\u00e7bir mesele yoktur ki, \u0130BN-\u0130 \u00c2B\u0130D\u0130N o s\u00f6zlerin hul\u00e2sas\u0131n\u0131 ve kabule en \u015fayan olan\u0131n\u0131 zikretmesin. Son devrin OSMANLI ulem\u00e2s\u0131 her halde bundan dolay\u0131 olacak \u0130BN-\u0130 \u00c2B\u0130D\u0130N&#8217;den ba\u015fka f\u0131k\u0131h kitab\u0131 aramaya l\u00fczum g\u00f6stermezlerdi. Mesel\u00e2 : Bizim Hocaz\u00e2de nam\u0131nda me\u015fhur ve mazinne-i kir\u00e2mdan bir \u00e2limimiz vard\u0131 ki, \u015fer&#8217;i memuriyetlerin en y\u00fcksek derecesine \u00e7\u0131kt\u0131\u011f\u0131 halde \u0130BN-\u0130 \u00c2B\u0130D\u0130N&#8217;den ba\u015fka bir kitaptan fetva vermezdi.<\/p>\n<p>\u0130\u015fte fakir de bu zevat\u0131n izlerinden y\u00fcr\u00fcyerek bu eseri tercemeye ba\u015flad\u0131m. Tercemede metinle \u015ferhi birbirinden ay\u0131rmaya imk\u00e2n olmad\u0131\u011f\u0131 i\u00e7in ikisine birden \u00abMET\u0130N\u00bb ad\u0131n\u0131 vererek bir arada yazd\u0131m. \u0130BN-\u0130 \u00c2B\u0130D\u0130N h\u00e2\u015fiyesine de \u00ab\u0130ZAH\u00bb s\u00f6z\u00fc ile i\u015faret ettim. Ve onu metinden ayr\u0131 olarak daima metnin alt\u0131na dercettim. \u0130bn-i \u00c2bidin&#8217;in nakletti\u011fi muhtelif kavilleri t\u0131rnak i\u015fareti i\u00e7ine ald\u0131\u011f\u0131m gibi icab\u0131nda kendi taraf\u0131mdan il\u00e2ve edilen ufak tefek izahlar\u0131 da parantez i\u00e7ine koydum. Ve zaten b\u00fcy\u00fck olan eserin hacmi daha da b\u00fcy\u00fcmesin diye baz\u0131 l\u00fczumsuz g\u00f6rd\u00fc\u011f\u00fcm tekrarlarla mesel\u00e2, Arap\u00e7a kelimelerin as\u0131llar\u0131ndan uzun uzad\u0131ya bahseden c\u00fcmleleri tercemeden hafettim.<\/p>\n<p>\u0130BN-\u0130 \u00c2B\u0130D\u0130N merhum nakletti\u011fi bir meseleyi nereden ald\u0131\u011f\u0131n\u0131 mutlaka ya kitab\u0131n a\u00e7\u0131k ismini s\u00f6yleyerek, yahut baz\u0131 harflerle i\u015faret ederek bildirmi\u015ftir \u00e7ok defalar, \u00abBu meseleyi filan kitab\u0131n sahibi filan yerden nakletmi\u015ftir\u00bb, der. Bazan k\u0131saltma yaparak meselenin sonunda sadece kitab\u0131n ad\u0131n\u0131 zikreder. Mesel\u00e2: Sadece &#8220;Zeyl\u00e2\u00ee&#8221;, &#8220;D\u00fcrer&#8221; gibi isimlerle iktifa eder, bazan daha da k\u0131saltarak o kitaba bir harfle i\u015farete bulunur. Haleb\u00ee&#8217;ye &#8220;H&#8221;, Tahtavi&#8217;ye &#8220;T&#8221; harfleriyle i\u015faret eyler.<\/p>\n<p>Merhumun bu usul\u00fcne ben de tamamen sad\u0131k kald\u0131m. Ve eserin herkes taraf\u0131ndan anla\u015f\u0131lmas\u0131n\u0131 sa\u011flamak i\u00e7in sade bir lisan kullanmaya elimden geldi\u011fi kadar gayret ettim. Bununla beraber \u0130sl\u00e2m hukukunun tamam\u0131n\u0131 ihtiva eden bu b\u00fcy\u00fck fennin \u00e7e\u015fitli \u0131st\u0131lahlar\u0131yla kendine mahsus terimlerini tamamiyle sadele\u015ftirmeye imkan bulamad\u0131m. Onun i\u00e7in pek l\u00fczumlu g\u00f6rd\u00fc\u011f\u00fcm baz\u0131 kelimeleri bir l\u00fcgat\u00e7e halinde ciltlerin sonuna ilaveye karar verdim. Fakat yine de baz\u0131 meselelerin anla\u015f\u0131lmas\u0131nda g\u00fc\u00e7l\u00fck \u00e7ekilecektir.
